INSTAGRAM COMPETITION TERMS
By submitting a competition entry, you are agreeing to be bound by these terms and conditions and all rules and guidelines applicable to the use of Instagram, including those located at https://help.instagram.com/581066165581870.
1. The promoter is: E L Lilley Limited (In-house Potter)
2. The following details are stated on the In-house Potter Instagram page:
a) title of the competition;
b) competition prizes;
c) information on how to enter; and
d) opening and closing dates and times.
3. To enter the competition you must follow the instructions on the In-house Potter Instagram page.
4. All competition entries received after the closing date are automatically disqualified.
5. No purchase necessary, however internet access is required.
6. The competition entries will be judged independently, and where possible (depending upon the nature of the competition), randomly. The decision of In-house Potter/the judge(s) (acting reasonably) will be final.
7. The competition is only open to all residents in the UK, except employees of In-house Potter or its holding or subsidiary companies or employees of agents or suppliers of In-house Potter or its holding or subsidiary companies, who are professionally connected with the competition or its administration.
8. In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. In-house Potter may require you to provide proof that you are eligible to enter the competition.
9. If you are under the age of 18, you must obtain written parental or guardian consent to enter and claim your prize. In-house Potter may ask the winner to provide proof of age.
10. In-house Potter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
11. Prizes are subject to availability and may be provided by a third party. There is no cash alternative for the prize.
12. In-house Potter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond In-house Potter’s control makes it necessary to do so.
13. The prize(s) is not negotiable or transferable.
14. In order to claim the prize you must follow In-house Potter’s reasonable instructions. Should you fail to do so the prize may be forfeited.
15. The decision of In-house Potter/the judge(s) is final and no correspondence or discussion will be entered into.
16. In-house Potter will contact the winner personally as soon as practicable after the closing date, using the Instagram account details used for the entry.
17. In-house Potter must either publish or make available information that indicates that a valid award took place. To comply with this obligation In-house Potter may publish your information submitted as part of the competition.
18. If you object to any of your information being published or made available, please contact In-house Potter on Instagram. In such circumstances, In-house Potter must still provide the information and winning entry to the Advertising Standards Authority on request.
19. Please allow for a reasonable amount of time before the prize(s) is delivered.
20. In-house Potter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 7 of days of the closing date, In-house Potter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received.
21. In-house Potter does not accept any responsibility if you are not able to take up the prize.
22. Insofar as is permitted by law, In-house Potter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of In-house Potter, its agents or distributors or that of their employees. Your statutory rights are not affected.
23. In-house Potter does not accept responsibility for network, computer or software failures of any kind and has no responsibility for lost, delayed, damaged or misdirected entries. In-house Potter does not accept any responsibility for any infringement of any third party intellectual property rights caused by entrants entering this promotion.
24. All competition entries and any accompanying material submitted to In-house Potter will become the property of In-house Potter on receipt.
25. By submitting your competition entry and any accompanying material, you agree to:
(a) assign to In-house Potter all your intellectual property rights with full title guarantee; and
(b) waive all moral rights,
in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
26. You agree that In-house Potter may, but is not required to, make your entry available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant In-house Potter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.
27. In-house Potter will only process your personal information as set out in the Privacy Policy (www.inhousepotter.com/privacy-policy).
28. If there is any reason to believe that there has been a breach of these terms and conditions, In-house Potter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
29. In-house Potter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
30. If any of these terms and conditions are found by a court or regulator to be invalid or unenforceable the remaining other provisions shall continue to apply.
31. This promotion is in no way sponsored, endorsed or administered by or associated with Facebook, Instagram or any other social media channel. By entering, entrants acknowledge that Facebook and Instagram do not bear any responsibility for this promotion and, to the maximum extent permitted by law, entrants release Facebook and Instagram from any liability whatsoever in connection with this promotion. All information entrants provide when they enter the promotion is provided to In-house Potter and not to Facebook, Instagram or any other social media channel.
32. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
